Terms of use

Doloris Meta Maze is an art attraction of Doloris B.V. and Doloris Anoma Maze is an art attraction of Doloris Utrecht B.V. These B.V.’s will hereinafter both be referred to as ‘DOLORIS’ and the Meta Maze and the Anoma Maze will hereinafter both be referred to as ‘the Maze’.  DOLORIS will, within reason, do everything possible to make the visit to the Maze satisfactory to the visitor. DOLORIS will exercise optimal care towards the visitor. DOLORIS will make every effort to keep any nuisance or inconvenience to the visitor to a minimum as well as to ensure the safety of the visitor as much as possible. DOLORIS is open to receive suggestions from the visitor for improving its services. At the counter, the visitor is given the opportunity to state findings and/or suggestions.

 

  1. General terms – definitions
  • DOLORIS– ‘DOLORIS’ means the organization that manages and operates the Maze, including, but not limited to, the management, employees and security as well as other officers authorized to act on behalf of DOLORIS.
  • Maze – ‘Maze’ means the whole of the premises located in Tilburg at Spoorlaan 21 and in Utrecht at 2e Daalsedijk 6 that fall under the legal or management authority of the management of DOLORIS, including, but not limited to, catering and event spaces and terraces.
  • Visitor – ‘Visitor’ means any person who enters the Maze and/or attends an event or attends as a guest by invitation an activity organized by DOLORIS or by third parties with the consent of DOLORIS at and in the Maze.
  • Agreement– The moment a Visitor enters the Maze, either as a paying Visitor or as a guest, he is deemed to have entered into an agreement with DOLORIS to which the Visitor Terms and Conditions apply (hereinafter: Visitor T&C). The Visitor T&C also apply to special activities within or outside regular opening hours and/or aimed at other than the regular Visitor, such as in the case of events or catering.
  • Applicability– The applicability of the Visitor T&C does not affect the possible applicability of other (contractual) conditions and/or regulations of DOLORIS. Concurrence with other specific (contractual) conditions of DOLORIS does not set aside the Visitor T&C. In case of conflict, the specific terms and/or regulations given for a particular activity shall prevail over the Visitor T&C.
  • Conditions for Visitors– The Visitor T&C are understood to be the general terms and conditions of DOLORIS, as filed with the Chamber of Commerce, under file number 70810702 (Doloris B.V.) and under 87948419 (Doloris Utrecht B.V.).

 

  1. Accessibility
  • The Maze and the spaces of DOLORIS are located in an accessible building in which activities are dispersed. It is best to take the local circumstances  into consideration as these affect the personal accessibility both inside and outside the building. The individual personal situation can also significantly affect this.
  • The Visitor is advised to be aware of any limitations regarding the personal experience of the Maze, such as claustrophobia.
  • For information on conditions that may present limitations to personal accessibility and options for individual assistance, reference is made to DOLORIS’ webpage ‘https://doloris.nl/nl/gezondheid/.’ If in doubt about personal accessibility, the Visitor is advised to contact DOLORIS staff.
  • The Maze is not accessible to persons under 12 years of age and to persons with a physical disability (wheelchair, broken limbs, etc.).
  • The Maze may only be visited at the Visitor’s own risk.
  • The Maze meets Dutch safety standards. Each Visitor is however requested to move through the Maze with caution given its physical intensity.

 

  1. Ticket sales, offers and pricing
  • All quotations made or otherwise provided in writing by DOLORIS are binding to the extent they are proprietary information materials present within the Maze at the time of issue or recently distributed by or on behalf of DOLORIS. DOLORIS shall not be liable for errors due to negligence or omission of third parties.
  • Each Visitor, when present in the Maze, must have a valid entrance ticket. He has only access through the designated entrances and paths.
  • The Visitor is at all times obliged to show the entrance ticket and any voucher or ticket entitling him/her to a discount on the entrance price to including but not limited to employees recognizable as such.
  • The Visitor is not entitled to a refund of the entrance fee or any other compensation in case of loss or theft of the entrance ticket before entering the Maze. If a Visitor does not use the pre-purchased entrance ticket, this is at the Visitor’s own expense and risk; this is also the case if the entrance ticket is only valid for a certain time and/or date. An entrance ticket once obtained cannot be exchanged. Nor will there be a refund of the entrance price. However, the paid entrance price may be refunded if circumstances beyond the buyer’s control make the Maze visit impossible, the latter however at the sole discretion of the management of DOLORIS, without prejudice to the provisions of the eight bullit of this section.
  • Tickets for the Maze can be changed to a new day up to a maximum of 24 hours before the reserved time slot in consultation with an authorized staff member of DOLORIS.
  • Up to 1 hour before the reserved time slot, a Visitor can change her time on the same date, subject to the availability of other times.
  • The (potential) Visitor may be denied access to the Maze if it appears that the entrance ticket, discount card or voucher has not been obtained from DOLORIS or a body authorized to do so by DOLORIS.
  • DOLORIS will refund the entrance price actually paid by the Visitor and travel expenses incurred within the Netherlands only, if the Visitor has to leave the Maze prematurely due to an unannounced exercise within the framework of the company emergency response (article 23 of the Dutch Arbowet), as well as in the event of an actual calamity as a result of which the Maze is fully or partially evacuated.
  • The provisions of this section do not apply to Visitors who enter and stay in the Maze as guests within the meaning of the 4th bullet of first (1)section.
  • Groups of 10 persons or more may cancel up to a maximum of 10% of the tickets purchased at any time free of charge, if coordinated with an authorized DOLORIS staff member prior to the visit.

 

  1. Staying in Meta Maze
  • The Visitor is prohibited from staying in or going to any part of the Maze other than to which the entrance ticket entitles the Visitor.
  • During the stay in the Maze, the Visitor must behave in accordance with public order and good morals and the rules of decency applicable to the Maze. The Visitor is also obliged to immediately follow the directions and instructions given by, but not limited to, employees of DOLORIS recognizable as such. If in the reasonable opinion of an authorized employee of DOLORIS, who must be recognizable as such, the Visitor acts in any way contrary to these standards, directions or instructions, the Visitor may be denied further access to the Maze, without the Visitor having any right to reimbursement of the cost of the entrance ticket or any other costs incurred.
  • The Visitor is prohibited from, among other things, entering the Maze: a) offering goods of any kind to third parties for sale, or providing them free of charge; b) deliberately and enduringly obstructing the way of other Visitors or blocking the view of exhibited objects; c) inconveniencing other Visitors, including, but not limited to, by the use of cell/mobile phones or other sources of noise disturbance; however, the use of such equipment may be expressly permitted by DOLORIS in certain areas; e) smoke; f) bring dangerous objects or substances with you in the opinion of an employee of DOLORIS recognizable as such; g) touch exhibited objects. Parents or supervisors of children must strictly ensure that exhibited objects are not touched by the children they bring with them. Teachers and supervisors of groups must ensure that the group members they supervise do not damage the exhibited objects.
  • In special cases where the general safety of persons or the Maze reasonably requires it, an employee of DOLORIS may require inspection of the (hand) luggage carried by the Visitor. Furthermore, if deemed necessary, specially trained and educated personnel may request the Visitor to cooperate with a security search upon entering or leaving the Maze. The potential Visitor will be warned before entering the Maze that this measure is in effect.
  • A video surveillance system is operational on the premises of DOLORIS. Visitors agree that video recordings may be made of them.
  • Copyright laws are applicable to the content of the Maze, such as to the exhibited objects. DOLORIS upholds those copyrights strictly. The publication or reproduction for commercial purposes of photographs, video and film recordings made in the Maze, in any manner and via any medium whatsoever, is prohibited without the prior written consent of the management of DOLORIS.
  • DOLORIS may deny access to the Maze permanently or for a certain period of time to the Visitor who, during one or more previous visits to the Maze, has deliberately damaged an object, or when the fear of damage is otherwise justified. In any case, DOLORIS may subject this Visitor to the measures mentioned in the 4th bullit of this section during all his visits. The decision to deny access will be communicated to this Visitor without delay, motivated and, if possible, in writing.

 

  1. Complaints
  • DOLORIS will make every effort to make visits to the Maze or DOLORIS-organized events and activities in accordance with the published offer. This includes the obligation to inform the public to the best of its ability about full, partial or early closure of the Maze and/or exhibitions or events organized by DOLORIS. Furthermore, DOLORIS will inform the potential public about any maintenance work, renovations or the (re)arrangement of spaces causing nuisance. The Visitor is not entitled to any compensation for such closure, work, renovation or (re)arrangement.
  • Complaints shall not be admissible with respect to the following circumstances: a) complaints relating to the invisibility of parts of objects in the Maze; b) complaints relating to the partial closure of the Maze, including, but not limited to, partial closure due to construction works, repairs or (re)arrangements. These circumstances shall never lead to any obligation to compensate  the Visitor by DOLORIS.
  • The Visitor may submit complaints and suggestions for improvement by sending an e-mail to itsme@doloris.nl

 

  1. Liability
  • The Visitor’s stay in the Maze is for his/her own account and risk.
  • DOLORIS shall only be liable for property damage suffered by the Visitor or injury of the Visitor if that is directly and exclusively the result of deliberate recklessness or gross negligence on the part of DOLORIS and/or its employees, in the understanding that only such damage qualifies for compensation for which DOLORIS is insured or should have been insured in all reasonableness and fairness and for the maximum amount used thereof.
  • The liability of DOLORIS is excluded for, amongst other things: a) damage as a result of the actions of third parties, including persons engaged by DOLORIS and tenants of (spaces in) the building and the persons engaged by these third parties; b) damage as a result of not following the instructions given by the DOLORIS employee and of not observing the rules of decency generally applicable; c) damage caused in any way by other Visitors; d) damage caused to vehicles of the Visitor.
  • DOLORIS shall never be liable for damages suffered by the Visitor as a result of force majeure on the part of DOLORIS. Force majeure shall include any circumstance beyond the control of DOLORIS – even if it could have been foreseen as a possibility at the time the agreement was concluded – which temporarily or permanently prevents fulfilment of the agreement, as well as, insofar as not already included therein, war, acts of war, civil war, terrorism, riots, police and/or fire department intervention, strikes, a pandemic, transport difficulties, fire and other serious disruptions to DOLORIS’ business c.q. in the building, weather conditions and non-functioning public transportation.

 

  1. Liability of Visitors
  • The Visitor to the Maze is liable for all direct and indirect damage he causes whether or not as a result of failure to comply with these Visitor T&C and indemnifies DOLORIS for claims by third parties in this regard.
  • The (original) holder of the entrance ticket is co-responsible and jointly liable for damage caused by the holder of this entrance ticket.
  • Parents or supervisors of children are at all times responsible and liable for the behavior of under-aged children they bring along. Teachers and supervisors of groups, without prejudice to each person’s own responsibility and liability, are co-responsible for and jointly liable for the behavior of group members they supervise.
  • Organizations organizing meetings, events and/or parties in the Maze are at all times responsible and liable for the behavior of the guests invited by them, without prejudice to their own responsibility and liability.

 

  1. Applicable law
  • Dutch law applies to these Visitor T&C and to the agreement between the Visitor and DOLORIS.
  • All disputes arising from the agreement between the Visitor and DOLORIS shall be submitted exclusively for adjudication by the court in the district of Zeeland-West Brabant.

 

Final clause

If one or more of the aforementioned provisions are or will become invalid, the remaining provisions will continue to be valid. In that case, a new provision will take the place of the invalid provision that corresponds to the old invalid provision as much as possible in terms of content, scope and/or objective.
